Capriles was elected to the National Congress of Venezuela on December 6, 1998, representing COPEI. He served as its Vice president until it was dissolved by the Constitutional Assembly in August 1999.

On July 30, 2000, Capriles was elected mayor of the Baruta Municipality, now representing Primero Justicia. He was re-elected on October 31, 2004, receiving 79% of the vote, beating the Chavista candidate, telenovela actor Simón Pestana.

Throughout most of 2004, Capriles was imprisoned for his alleged role in the protest outside of the Cuban embassy during the April 2002 Venezuelan coup attempt. He was released from prison after he was re-elected mayor, but now faces a trial for his alleged role, which is expected to take place on November 27, 2006.
