He was born in New York City, but he and his family moved to Los Angeles when he was a young child. In Hollywood, his father was a small-scale film producer. His father's connections are what tied young Max into many small films such as Face/Off (although his part was so small his name wasn't listed in the credits). He was also the baby model in the poster for the Coen Brothers' film Raising Arizona. He learned to play piano at a young age, which prompted his later interest in music. He is Jewish, and also suffers from Bipolar Disorder (he was diagnosed in 2005, after a nervous breakdown shortly before the re-issue of ...Is a Real Boy).
Max met the future Say Anything drummer, Coby Linder, at Camp Ramah in Ojai, California. He met two other band members, Evan Span and Michael Levin, at the Windward School in Los Angeles.
Say Anything was formed after a bad breakup for Max, who wrote a few songs afterwards and coerced his friends into helping him play and distribute them. They spread through and became popular in the Los Angeles music scene, and the band began. The band started with Max on rhythm guitar and vocals, Evan Span on lead guitar, Coby Linder on drums, and Mike Levin on bass, however, after the band produced its first album, Junior Varsity EP (four songs about high school), Evan Span left the band and Max took over guitar. In 2001, the band produced Baseball, which was 72 minutes long and well received. The band disbanded when Max left to go to college at Sarah Lawrence College in Bronxville, New York. After his college stint, the band reunited, consisting of Max, Coby Linder, and bassist Dan Delauro. They released Menorah/Majora together in 2003. They were signed to Doghouse Records in the following year. Under Doghouse, Max and Coby released their proper debut, ...Is a Real Boy on August, 3 2004, written mostly by Max and co-produced by Tim O'Heir.
The band was signed to J Records in 2005 and re-recorded their popular song "Alive With The Glory Of Love", which describes his Jewish grandparents' ordeal in a Polish concentration camp, Treblinka, during the Holocaust.
